Making a Will ensures that when you die, your estate is dealt with according to your wishes.
With effective planning, a Will can also make sure your loved ones are also provided for in a tax-efficient way.
If you do not make a Will, the law will divide your estate according to the rules of intestacy pursuant to the Distribution Act 1958.
This rule are very rigid and may not reflect who you want your wealth goes to or how your assets are distributed.
If you are worried that you will lose the ability to manage your own affairs in the future, you may want to consider making a Lasting Power of Attorney.
This means that you appoint someone else to make decisions on your behalf if you lose mental capacity.
These decisions include:
a) how to manage your finances
b) your health and wealth
c) type of medical care and treatment you receive
d) what happens if you have to move into a care home
e) what happens to your business (if you are a business owner)
